TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COLLECTIVE LIABILITY OF USAGAINSTALZHEIMER’S AND ITS SUBSIDIARIES AND AFFILIATES, AND THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS, TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED ONE HUNDRED DOLLARS ($100).

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Copyright Violations

If you believe that any material on this website infringes your copyright, please notify us as follows, under the Digital Millennium Copyright Act ("DMCA"). To notify us, the DMCA requires that you:

1. Send an email notice to UsAgainstAlzheimer’s to: squirk@usagainstalzheimers.org

2. Include the following information in your email:

a. Identify of the copyrighted work(s) you claim is infringed;

b. Identify the material you claim is infringing the copyright(s), and give enough information for UsAgainstAlzheimer’s to locate that material;

c. Include a physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf (the "Claimant");

d. Include the Claimant's name, address, and telephone number(s);

e. Include a statement that the Claimant has a good faith belief that use of the disputed material is not authorized by the copyright owner or his agent; and

f. Include a statement, under penalty of perjury, that the information in the notification of copyright infringement is accurate and that the Claimant is the copyright owner or is authorized to act on behalf of the copyright owner

If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA notice may not be effective.

If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter notification with us (a "Counter Notice") by submitting written notification to our copyright agent designated above. Pursuant to the DMCA, the Counter Notice must include substantially the following:

  • Your physical or electronic signature;
  • An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled;

The DMCA allows us to restore the removed content if the party filing the original DMCA notice does not file a court action against you within ten (10) business days of receiving the copy of your Counter Notice.

Please be aware that if you knowingly materially misrepresent that material or activity on the Site is infringing your copyright or if you knowingly materially misrepresent that material or activity on the Site was removed or disabled by mistake or misidentification, you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

Termination

If UsAgainstAlzheimer’s believes, in its sole discretion, that you have violated these Terms or the Privacy Policy, UsAgainstAlzheimer’s reserves the right to immediately terminate your access to the Site, in addition to any other remedies available at law.

Governing Law and Jurisdiction

All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the Washington DC without giving effect to any choice or conflict of law provision or rule (whether of Washington DC or any other jurisdiction).
